This website is operated by Obsession Watches. Throughout the website, the terms “we,” “us,” and “our” refer to Obsession Watches.

Obsession Watches provides this website, including all information, content, features, tools, products and services available through it, to offer customers a curated shopping experience (the “Services”). Our store is powered by Shopify, which enables us to provide the Services.

These Terms of Service (“Terms”) describe your rights and responsibilities when accessing or using the Services or purchasing products from us.

By accessing the Services or placing an order, you agree to these Terms, our Privacy Policy, Refund Policy and Shipping Policy. If you do not agree, you should not use the Services.

Nothing in these Terms limits any mandatory consumer rights that apply to you under the laws of your country or region.

Section 1 – Eligibility and Accounts

By using the Services, you confirm that you are at least the age of majority in your jurisdiction or that you are using the Services with the permission and supervision of a parent or legal guardian.

You agree to provide accurate, current and complete information when creating an account or placing an order.

You are responsible for maintaining the confidentiality of your account credentials and for activity performed through your account. Please contact us immediately if you believe that your account has been accessed without authorization.

Section 2 – Products and Product Representations

We make reasonable efforts to display and describe our products accurately. However, colors and finishes may appear differently depending on your screen, lighting conditions and device settings.

Certain photographs, videos or images may be digital renders or pre-production representations of products that are still in development. Where applicable, this will be stated on the relevant product page.

We intend for the finished products to follow the displayed designs as closely as reasonably possible. Minor, non-material variations may occur because of manufacturing processes, lighting, stone placement, surface finish, texture or component availability. These variations do not affect your rights if a product is defective, materially different from its description or otherwise non-conforming.

Product dimensions, materials, finishes and other specifications will be displayed on the relevant product page. We may improve or adjust technical components when necessary for safe, reliable production, provided that such changes do not materially alter the product’s overall design or quality.

Our watches should not be considered water-resistant unless a specific water-resistance rating is expressly stated on the product page. Products containing small decorative components should be kept away from small children.

We may limit product quantities, discontinue products or restrict sales to particular countries or regions when reasonably necessary.

Section 3 – Pre-Orders

Certain products may be offered for pre-order before production or general availability.

By placing a pre-order, you acknowledge and agree that:

1. payment will be collected when your order is placed;

2. the product is not available for immediate dispatch;

3. the estimated dispatch window will be displayed on the product page before checkout;

4. production and fulfillment times are estimates and may be affected by manufacturing, quality-control, customs, logistics or other circumstances outside our reasonable control.

The estimated dispatch window applicable to each pre-order will be clearly displayed on the relevant product page before purchase and included in the order confirmation. The dispatch window shown when the order is placed will apply to that order.

The watches are produced or reserved as part of a wider production run based on customer demand. A standard pre-order product is not automatically considered personalized or custom-made solely because it is produced after the order is placed.

If the estimated dispatch window changes materially, we will contact affected customers using the email address provided with the order and provide updated information and any choices required by applicable law.

If we cannot ship within the advertised timeframe, we may request your agreement to a revised timeframe or provide another remedy required by applicable law.

You may request cancellation before your order enters fulfillment or is dispatched. Although we will make reasonable efforts to accommodate the request, we cannot guarantee that an order can be stopped once fulfillment has started. This does not limit any cancellation, withdrawal or return rights provided by applicable law or our Refund Policy.

Section 4 – Orders

Placing an order constitutes an offer to purchase products from us. An order is accepted when we send an order confirmation or otherwise confirm that we have accepted it.

We reserve the right to decline or cancel an order for legitimate reasons, including suspected fraud, payment authorization problems, incorrect pricing, product unavailability, shipping restrictions or violations of these Terms.

If we decline or cancel an order after payment has been collected, we will refund the applicable amount to the original payment method.

Please review your order details carefully before submitting it. If you notice an error in your email address, shipping address, product selection or quantity, contact us as soon as possible at theobsessionwatches@gmail.com.

Products purchased through the Services are intended for personal or household use unless we have agreed otherwise in writing.

Section 5 – Prices, Payments and Billing

Prices are displayed in the currency selected for your market. The total amount payable to us will be shown during checkout before you complete your order.

Shipping charges, taxes, duties or other charges collected by us will be displayed at checkout where applicable.

Depending on the destination country, local authorities or delivery carriers may charge import duties, taxes or customs fees that are not collected by us at checkout. Unless checkout specifically states that duties and import taxes are included, the customer may be responsible for these charges.

Prices, discounts and promotions may change without notice. Any change will not affect an order that has already been accepted, except where an obvious pricing or technical error has occurred.

You agree to provide current, complete and accurate billing and payment information. You confirm that you are authorized to use the payment method submitted with your order.

Section 6 – Promotions and Bundles

We may offer promotional prices, product bundles, limited-time offers or post-purchase offers.

Each promotion may be subject to additional conditions displayed with the offer. If specific promotional conditions conflict with these Terms, the specific promotional conditions will apply to that promotion.

Availability, promotional periods and product quantities may be limited. Any additional post-purchase product requires the customer’s express agreement and will not be added automatically.

Discounted products remain covered by applicable consumer rights and our Refund Policy unless a product is clearly identified as final sale and excluding returns is legally permitted.

Section 7 – Shipping and Delivery

We ship to the countries and regions available during checkout. Available destinations and shipping options may change.

Estimated production, dispatch and delivery times are provided in good faith but are not guaranteed. Delivery estimates begin after dispatch unless expressly stated otherwise.

Delivery may be affected by production, quality-control procedures, carriers, customs, weather, local authorities, peak periods or other events outside our reasonable control. We will provide updates when we become aware of a significant delay.

Where we arrange shipment, the risk of loss or damage remains with us until you or a person designated by you, other than the carrier, receives physical possession of the order, except where applicable law provides otherwise.

If tracking shows that an order has been delivered but you cannot locate it, contact us promptly so that we can investigate with the carrier.

The customer is responsible for providing a complete and accurate delivery address. If incorrect or incomplete information causes an order to be returned, additional shipping charges may apply before it is resent. This does not apply where the delivery problem was caused by us or the carrier.

Any optional shipping-protection service will be described separately at checkout. Declining optional shipping protection does not remove any mandatory rights you may have regarding goods lost or damaged before delivery.

Section 8 – Returns, Cancellations and Refunds

Returns, cancellations, replacements and refunds are handled according to our Refund Policy.

Nothing in these Terms or our Refund Policy limits any mandatory right of withdrawal, legal guarantee or remedy available to consumers under applicable law.

If you receive an incorrect, damaged or defective product, contact us promptly at theobsessionwatches@gmail.com and include your order number and clear photographs or videos showing the issue.

If an order has already entered fulfillment or has been dispatched, we may be unable to stop delivery. Where applicable, you may still exercise your return or withdrawal rights after receiving the product.

Section 9 – Intellectual Property

The Services and their contents, including the Obsession Watches name, designs, watch concepts, logos, product photographs, videos, graphics, text, page layouts and other materials, are owned by or licensed to Obsession Watches and are protected by applicable intellectual-property laws.

You may access and use the Services only for personal and non-commercial purposes.

Without our prior written permission, you may not reproduce, distribute, modify, publish, sell, commercially exploit or create derivative works from our content or product designs, except where permitted by law.

Shopify’s names, trademarks and materials remain the property of Shopify or its licensors.

Section 10 – Optional Tools and Third-Party Services

We may provide access to services or tools operated by third parties, including payment providers, review platforms, delivery services and other integrations.

Third-party services may be subject to their own terms and privacy policies. We are not responsible for third-party services to the extent permitted by law, but this does not limit our responsibility for obligations that legally remain with us as the seller.

We may introduce, replace or discontinue features and integrations when reasonably necessary.

Section 11 – Third-Party Links

The Services may contain links to websites or services operated by third parties.

We do not control and are not responsible for the content, availability, privacy practices or security of third-party websites. You should review their terms and policies before providing information or completing a transaction with them.

The inclusion of a link does not necessarily imply our endorsement of the third party.

Section 12 – Relationship With Shopify

Obsession Watches is powered by Shopify, which provides the ecommerce infrastructure used to operate the store.

Purchases made through our store are transactions directly between you and Obsession Watches. Shopify is not the seller of the products offered by Obsession Watches.

Shopify may process certain personal information as described in our Privacy Policy and the Shopify Consumer Privacy Policy.

Section 13 – Privacy

Personal information collected through the Services is handled according to our Privacy Policy.

Because our store is hosted by Shopify, information may be processed by Shopify and other service providers in countries different from your country of residence, subject to applicable data-protection requirements.

Section 14 – Reviews and Feedback

If you submit a review, photograph, suggestion, comment or other feedback (“Feedback”), you confirm that you have the right to submit it and that it does not violate the rights of another person.

You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce and display the Feedback for operating, improving and promoting the Services, subject to applicable privacy and consumer-protection laws.

You remain responsible for the accuracy and legality of your Feedback. We may remove Feedback that is unlawful, misleading, abusive, fraudulent or infringes another person’s rights.

Any compensation or incentive provided in connection with a review must be clearly disclosed.

Section 15 – Errors and Availability

Occasionally, the Services may contain typographical errors, inaccurate information or omissions relating to product descriptions, prices, promotions, availability or delivery estimates.

We may correct errors and update information when reasonably necessary. If a correction materially affects an order that you have already placed, we will contact you and provide any options required by applicable law.

We do not use this provision to avoid fulfilling an accepted order merely because a later price is less favorable to us.

Section 16 – Prohibited Uses

You may use the Services only for lawful purposes.

You must not:

1. violate applicable laws or the rights of another person;

2. infringe intellectual-property, privacy or other legal rights;

3. provide fraudulent, false or misleading information;

4. transmit viruses, malware or harmful code;

5. attempt to gain unauthorized access to the Services or another customer’s account;

6. interfere with the security or operation of the Services;

7. scrape, copy or commercially exploit substantial portions of the Services without permission;

8. use the Services to send spam, harassment, threats or unlawful content;

9. impersonate another person or entity;

10. use automated systems in a manner that places an unreasonable burden on the Services or circumvents technical protections.

We may restrict or terminate access where we reasonably believe these Terms have been violated.

Section 17 – Suspension and Termination

We may suspend or terminate access to the Services where reasonably necessary to protect customers, prevent fraud, maintain security, comply with the law or respond to a material breach of these Terms.

Termination does not affect rights and obligations that arose before termination, including payment obligations, accepted orders, intellectual-property rights and provisions that are intended to survive termination.

Section 18 – Warranties and Consumer Rights

We provide the Services with reasonable care. However, we do not guarantee that the website will always be uninterrupted, completely secure or free from technical errors.

Products are subject to any warranties, legal guarantees and conformity rights required by applicable law.

Nothing in these Terms excludes or limits rights relating to products that are defective, unsafe, materially different from their description or otherwise non-conforming.

Any exclusion or limitation of an implied warranty applies only to the extent permitted by law.

Section 19 – Limitation of Liability

To the fullest extent permitted by law, Obsession Watches will not be liable for indirect or consequential losses that were not reasonably foreseeable when the contract was formed.

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, defective products where liability is mandatory, or violations of mandatory consumer rights.

Our liability for a direct loss connected with an order will be determined according to applicable law and the circumstances of the claim.

Section 20 – Indemnification

To the extent permitted by law, you agree to be responsible for losses or claims arising directly from your unlawful misuse of the Services, your infringement of another person’s rights or your material breach of these Terms.

This provision does not make a consumer responsible for losses caused by Obsession Watches, Shopify or their service providers and does not limit mandatory consumer rights.

Section 21 – Events Outside Our Control

We are not responsible for a failure or delay caused by events reasonably outside our control, such as natural disasters, serious transport disruption, strikes, government restrictions, customs disruption, war, civil unrest, widespread telecommunications failures or major supply-chain interruption.

If such an event materially affects an accepted order, we will provide relevant updates and any remedies required by applicable law.

Section 22 – Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted or removed to the minimum extent necessary.

The remaining provisions will continue in effect.

Section 23 – Waiver and Entire Agreement

A failure or delay in enforcing a provision of these Terms does not constitute a waiver of that provision.

These Terms and the policies referenced within them form the agreement between you and Obsession Watches concerning your use of the Services and purchases from the store.

They do not exclude representations or rights that cannot legally be excluded.

Section 24 – Assignment

You may not transfer your rights or obligations under these Terms without our written consent, except where applicable law permits otherwise.

We may transfer our rights or obligations as part of a legitimate sale, restructuring or transfer of the business, provided that doing so does not reduce your mandatory rights.

Section 25 – Governing Law and Disputes

These Terms are governed by the laws of Italy.

If you are a consumer, this choice of law does not deprive you of mandatory protections available under the laws of the country in which you habitually reside.

Nothing in these Terms limits any right a consumer may have to bring proceedings before a court that has jurisdiction under applicable law.

Section 26 – Changes to These Terms

We may update these Terms to reflect changes to the Services, our business practices or applicable requirements.

The updated version will be posted on this page with a revised “Last updated” date. Where required by law, we will provide additional notice of material changes.

Changes will not retroactively reduce rights connected with an order that was accepted before the changes became effective.
